Boundary Dispute Mediation Agreement

It is important to look at the border as a problem that needs to be addressed, and since it concerns both, you should work together to address it together. Too often, it is not ambiguity in the description of the border, but the indignation of a landowner in response to a neighbour`s action, and indignation promotes antagonism and prevents cooperation. In 2016, the Civil Judicial Council was invited by the Ministry of Justice to make recommendations to improve the settlement of disputes between individuals over borders with their country. The trees belong to the person who asked the riddle, and that person is certainly responsible for their maintenance, that is, the cutting. Growing trees across the border is an interference in the neighbour`s country, which is a legal nuisance. In some circumstances, access to neighbouring land may be a problem. In this case, the neighbour may take the trouble to cut down the trees, which relieves the intervention, but he or she may be charged with either criminal damage to trees or theft of valuable parts (e.g. B fruit) trees. I will cite the following examples as a general guide to the costs of resolving a border dispute. 7.1 In order to reach an agreement, it is important that the parties are aware of what has been agreed.

Agreements can be made by reference to lines on plans or lines on the ground. When the parties negotiate a plan by referring to a line, they need to know that they understand where that line will be on the ground. It is generally advisable to negotiate by referring to a local line (i.e. mark the proposed line on the ground) to ensure that there is no misunderstanding. The only area in which I have the power to communicate to the land office the exact line of a border is, in those rare cases where two clients jointly order me to carry out a legally binding expert mandate. In all other circumstances, the land registry has the power to summarily reject my precise demarcation line, which risks turning an amicable border into a border conflict.
